Create a federal digital-replica right (consent for voice & likeness)

A property-like federal right against unauthorized AI simulation of a performer's voice or likeness, with consent and compensation requirements, the NO FAKES Act ask.

Where it stands

Adopted at state level (Tennessee ELVIS Act in force Jul 2024; California digital-replica laws) and in the intimate-imagery slice federally (TAKE IT DOWN Act signed May 19, 2025; 48-hour platform takedown effective May 19, 2026). The broader federal digital-replica right is advancing: NO FAKES reintroduced Apr 2025, revised as S.4591 (NO FAKES Act of 2026) and placed on the Senate calendar Jun 24, 2026 over CCIA/NetChoice objections to notice-and-staydown. USCO Part 1 recommended a federal right (Jul 2024). The UK opened a digital-replicas workstream (Mar 2026); the EU omnibus added an AI Act prohibition on generating NCII/CSAM (May 2026).
